I Comuni, ma anche Province, ANAS e Società Autostrade, sono legalmente responsabili per i danni causati a persone e cose dalle buche stradali. Dunque, infortuni e guasti agli automezzi devono essere indennizzati da questi Enti, che dovrebbero avere la manutenzione ordinaria del manto stradale.

Ma attenzione, per avere tale diritto devono esservi due condizioni: l’invisibilità e l’imprevedibilità.

Dunque, aver ragione se il danno è avvenuto di giorno è più difficile; mentre se la cosa accade nelle ore serali o notturne si ha automaticamente diritto al risarcimento.
