La sentenza della Corte di Cassazione n. 23301 del 17.11.2005 ha ribaltato l’orientamento in tema di multe prese ai semafori con apparecchiature Photored.

La Cassazione ha affermato la necessità della presenza degli Agenti, perchè solo tale presenza può essere indice dell’effettiva veridicità dell’infrazione.

Si torna, quindi, allo spirito dell’originario Codice della Strada. E si torna alla possibilità di poter ricorrere a questi verbali, aggiungendo questo particolare alle altre iniquità degli accertamenti, fra cui la mancata taratura dell’apparecchio e l’illegittimità della stessa postazione, non corrispondente agli stessi requisiti ministeriali.
